Terms & Conditions

Last updated: May 1, 2026

1. Introduction & Acceptance

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Property Bounty Inc. (“Property Bounty,” “we,” “us,” or “the Platform”), a corporation incorporated under the laws of the Province of Ontario, Canada. These Terms govern your access to and use of the Property Bounty website, application, and all related services (collectively, the “Service”).

By creating an account, funding a bounty, submitting a property match, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must immediately cease using the Service and deactivate your account.

These Terms supplement and incorporate by reference our Privacy Policy, which describes how we collect, use, and protect your personal information. Together, these documents form the complete agreement between you and Property Bounty regarding the Service.

2. Definitions

Throughout these Terms, the following capitalized words carry specific meanings:

  • Buyer — A registered User who creates and funds a Bounty.
  • Bounty Hunter — A registered User who has activated Bounty Hunter mode and submits property matches against Bounties.
  • Bounty — A listing created by a Buyer that describes desired property criteria, a geographic area, and a Reward amount payable to a Bounty Hunter upon successful deal closure.
  • Submission — A property match submitted by a Bounty Hunter against an open Bounty, including the property address, asking price, seller contact details, and any supporting documentation.
  • Reward — The amount, denominated in Canadian Dollars (CAD), that a Buyer commits to pay a Bounty Hunter upon successful closing of a deal originated through the Platform.
  • Platform Fee — A fee equal to 10% of the Reward, charged to the Buyer at checkout and retained by Property Bounty. Refundable if the Bounty is cancelled or expires before matching, or if a dispute is resolved in the Buyer’s favour.
  • Processing Fee — A non-refundable fee equal to 3.5% of the Reward, charged to the Buyer at checkout. Covers card processing costs incurred by the Platform.
  • Reward Charge — The off-session charge of the Reward to the Buyer’s saved payment method that occurs when the Buyer accepts a matching Submission.
  • Held Amount — The amount actually charged to the Buyer at checkout (Platform Fee + Processing Fee).
  • Closing — The event in which a Buyer attests that a real-world property transaction has been completed with a seller introduced through a Submission.
  • Counter-Sign — The Bounty Hunter’s confirmation that the Closing is legitimate, or the automatic confirmation that occurs after the Counter-Sign Window elapses without a dispute.
  • Counter-Sign Window — The seven (7) calendar day period following a Closing during which the Bounty Hunter may counter-sign or file a dispute.
  • Dispute — A formal objection filed by a Bounty Hunter during the Counter-Sign Window challenging the legitimacy of a Closing.
  • Prohibited Conduct — Any activity described in Section 12 of these Terms.
  • Intellectual Property — All trademarks, service marks, trade names, logos, copyrights, trade secrets, proprietary algorithms, database rights, domain names, and other intellectual property owned by or licensed to Property Bounty.

3. Eligibility

To use the Service, you represent and warrant that:

  1. You are at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater.
  2. You have the legal capacity and authority to enter into binding contracts under applicable law.
  3. You are not a person or entity subject to trade sanctions, export restrictions, or anti-money-laundering prohibitions under Canadian federal law, the Criminal Code of Canada, the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA), or any other applicable legislation.
  4. You have not previously been suspended, banned, or otherwise removed from the Platform for violation of these Terms.
  5. If acting on behalf of a corporation, partnership, trust, or other legal entity, you have the authority to bind that entity to these Terms, and “you” refers to both you individually and the entity.
  6. All information you provide during registration and verification is accurate, complete, and current.

Buyer-specific eligibility: Buyers must complete business verification, including providing a valid business name and business number, before creating or funding any Bounty. Property Bounty reserves the right to reject business verification applications at its sole discretion and without providing a reason.

Bounty Hunter-specific eligibility: Bounty Hunters must activate Bounty Hunter mode and complete Stripe Connect payout onboarding (including identity verification and banking details) before any Reward can be released. Bounty Hunters are solely responsible for ensuring their activities comply with all applicable real estate licensing and regulatory requirements in their jurisdiction. Property Bounty does not verify Bounty Hunter licensing status and makes no representation that Bounty Hunter activities are lawful in any particular jurisdiction.

4. Account Registration & Security

  1. One account per person. Each individual may maintain only one (1) account. Creating multiple accounts to circumvent suspension, abuse referral programs, manipulate reputation scores, or for any other purpose is strictly prohibited and constitutes grounds for immediate and permanent termination of all associated accounts.
  2. Accurate information. You agree to provide truthful, current, and complete information during registration and to update it promptly if it changes. Providing false identity information, fictitious business details, or fraudulent documentation is a material breach of these Terms and may be reported to law enforcement.
  3. Credential security. You are solely responsible for safeguarding your password and any session tokens. You must immediately notify us at [email protected] if you suspect unauthorized access to your account. Property Bounty is not liable for any loss arising from your failure to secure your credentials.
  4. Suspension & termination. We may, at our sole discretion, suspend or permanently terminate your account for any reason, including but not limited to: violation of these Terms, suspected fraud, non-payment, abusive behavior, regulatory requirements, or inactivity exceeding twelve (12) months. Upon suspension, all active sessions are immediately destroyed. Upon termination, any outstanding Bounty funds will be handled according to Section 7 (Refunds & Cancellations).
  5. Account data. Upon termination, we may retain your account data as required by law, for fraud prevention, or for the resolution of ongoing disputes, but we are under no obligation to maintain or provide access to your data after termination.

5. Bounty Lifecycle & Payment Flow

5.1 Creation & Funding

  1. A Buyer creates a Bounty by specifying property criteria (type, location, price range, and optional detailed requirements) and a Reward amount.
  2. The Bounty remains in draft status until the Buyer completes checkout.
  3. At checkout, the Buyer is charged the Platform Fee plus the Processing Fee via Stripe. The Reward itself is not charged at checkout; instead, the Buyer’s payment method is saved for the Reward Charge.
  4. Upon successful payment, the Bounty becomes publicly visible and open to Bounty Hunter submissions.
  5. When the Buyer accepts a matching Submission, the Platform charges the Reward off-session against the Buyer’s saved payment method. If the off-session charge fails, the acceptance is rejected and the Submission remains pending.
  6. The Buyer sets a submission deadline (after which no new Submissions are accepted) and an expiry date (after which the Bounty may be cancelled and refunded if no deal has closed).

5.2 Submissions

  1. Bounty Hunters browse open Bounties and submit matching properties. Each Submission must include, at minimum, the property address and seller contact details.
  2. Bounty Hunters are limited to one (1) Submission per calendar day across the entire Platform. This limit exists to encourage quality over volume.
  3. The Buyer reviews Submissions and may accept one. Accepting a Submission immediately and irrevocably auto-rejects all other pending Submissions for that Bounty.
  4. The Buyer may reject Submissions with a stated reason. Rejections are final and cannot be reversed by the Buyer.
  5. Submitting false, fabricated, or plagiarized property information is Prohibited Conduct and will result in immediate account suspension.

5.3 Closing & Counter-Sign

  1. After accepting a Submission and completing the real-world property transaction, the Buyer attests the deal as closed on the Platform.
  2. The Bounty Hunter then has a Counter-Sign Window of seven (7) calendar days to either confirm the Closing or file a Dispute.
  3. If the Bounty Hunter counter-signs, the Closing is confirmed and the Reward is transferred to the Bounty Hunter via Stripe Connect automatically.
  4. If the Bounty Hunter takes no action within the Counter-Sign Window, the Closing is auto-confirmed and the Reward is released. The Bounty Hunter’s inaction is deemed acceptance.
  5. If the Bounty Hunter files a Dispute within the Counter-Sign Window, the Closing is suspended and the matter is escalated to Property Bounty for resolution under Section 10.

5.4 Payout

  1. Upon confirmed Closing, the Reward is transferred to the Bounty Hunter via Stripe Connect. The Platform Fee is retained by Property Bounty.
  2. The Bounty Hunter must have completed Stripe Connect onboarding (identity verification and banking details) before funds can be released. If onboarding is incomplete, the payout will be held until onboarding is complete or the payout is marked as failed.
  3. Property Bounty is not responsible for delays caused by Stripe, the Bounty Hunter’s bank, or incomplete onboarding.
  4. All payouts are final. Once released, funds cannot be clawed back by the Platform except as required by law or in cases of proven fraud.

6. No-Circumvention Obligation

This section is a material term of these Terms. You acknowledge that circumvention of the Platform’s payment system undermines the entire marketplace and harms all participants.

6.1 Buyer Obligations

  1. No off-platform deals. If a Buyer becomes aware of a property through a Bounty Hunter Submission — whether that Submission was accepted, rejected, or withdrawn — the Buyer shall not pursue, negotiate, or close a transaction involving that property (or the seller thereof) outside the Platform in order to avoid paying the Reward. This obligation survives for twenty-four (24) months following the date the Submission was first viewed by the Buyer.
  2. No straw buyers. Buyers shall not arrange for any affiliate, associate, family member, business partner, related entity, or any other third party to acquire a property introduced through the Platform on the Buyer’s behalf in order to avoid paying the Reward.
  3. No false rejections. Buyers shall not reject a Submission for the purpose of subsequently pursuing the same property outside the Platform. Rejecting a Submission and then contacting the seller identified in that Submission within twelve (12) months creates a rebuttable presumption of circumvention.
  4. Obligation to disclose. If a Buyer closes a real-world transaction with a seller who was introduced through any Submission on the Platform — regardless of whether the Submission was accepted — the Buyer must report the Closing through the Platform within fourteen (14) calendar days.

6.2 Bounty Hunter Obligations

  1. No side deals. Bounty Hunters shall not solicit, accept, or receive any payment, commission, fee, or other compensation from a Buyer or seller outside the Platform in connection with a Submission or a property introduced through the Platform.
  2. No bid manipulation. Bounty Hunters shall not collude with Buyers to artificially lower Reward amounts, split Rewards off-platform, or otherwise manipulate the Bounty system.

6.3 Consequences of Circumvention

Circumvention is a material breach of these Terms. If Property Bounty determines, in its sole discretion, that circumvention has occurred:

  • The offending User’s account will be permanently suspended without prior notice.
  • The Buyer remains liable for the full Reward amount plus the Platform Fee, even if no payment was made through the Platform.
  • Property Bounty reserves the right to pursue legal action to recover the Reward, the Platform Fee, consequential damages, legal costs, and any other amounts owed.
  • Property Bounty may refer the matter to applicable regulatory authorities if the circumvention involves fraud, misrepresentation, or other criminal conduct.
  • The offending User forfeits any right to refunds or pending payouts.
  • Property Bounty may, at its discretion, publish anonymized case summaries of circumvention incidents as a deterrent.

7. Refunds & Cancellations

  1. Refund formula — before matching. If a Bounty is cancelled or expires before the Buyer accepts a Submission, the Platform Fee is refunded to the Buyer’s original payment method. The Processing Fee is non-refundable.
  2. Refund formula — after matching. If a dispute is resolved in the Buyer’s favour after the Reward has been charged, the full Reward and the Platform Fee are refunded. The Processing Fee remains non-refundable.
  3. Cancellation before matching. A Buyer may cancel a Bounty at any time before accepting a Submission. The refund formula in clause 1 applies.
  4. Cancellation after matching. Once a Buyer accepts a Submission and the Reward Charge has succeeded, the Bounty cannot be unilaterally cancelled by the Buyer. The Bounty remains active until the deal closes, a dispute is resolved, or the Bounty expires. If the deal falls through for reasons unrelated to the Bounty Hunter’s performance, the Buyer may request cancellation through the dispute process.
  5. Expired bounties. If a Bounty reaches its expiry date without a closed deal, the refund formula in clause 1 applies.
  6. Dispute-initiated refunds. If a dispute is resolved in the Buyer’s favour, the Bounty is cancelled and the refund formula in clause 2 applies. See Section 10.
  7. Refund processing. Refunds are processed through Stripe to the original payment method. Processing times depend on the Buyer’s bank and are typically 5–10 business days. Property Bounty is not responsible for delays caused by the Buyer’s financial institution.
  8. No refund after payout. Once a Reward has been released to a Bounty Hunter following a confirmed Closing, the transaction is final. The Platform Fee is non-refundable once a payout has been released.
  9. Forfeiture. Users whose accounts are terminated for Prohibited Conduct forfeit all rights to refunds and pending payouts. Forfeited amounts may be used to compensate affected Users or retained by the Platform.

8. Fees & Payments

  1. Platform Fee. The Platform charges a Platform Fee equal to ten percent (10%) of the Reward, payable by the Buyer at checkout. The Platform Fee is non-negotiable but is refundable if the Bounty is cancelled or expires before matching, or if a dispute is resolved in the Buyer’s favour.
  2. Processing Fee. The Platform charges a Processing Fee equal to three and one half percent (3.5%) of the Reward, payable by the Buyer at checkout. The Processing Fee is non-refundable in all circumstances and covers card processing costs incurred by the Platform.
  3. Reward Charge. The Reward is not charged at checkout. When the Buyer accepts a matching Submission, the Platform charges the Reward off-session against the payment method saved at checkout. If the off-session charge fails, the acceptance is rejected.
  4. Currency. All amounts on the Platform are denominated in Canadian Dollars (CAD). If your payment method is in a different currency, your bank may apply conversion fees for which Property Bounty is not responsible.
  5. Payment processor. All payments are processed by Stripe, Inc. By using the Platform, you agree to Stripe’s Terms of Service and Stripe Connected Account Agreement (for Bounty Hunters). Property Bounty is not responsible for Stripe’s fees, processing delays, or service disruptions.
  6. Taxes. Users are solely responsible for determining and paying any taxes, duties, or levies arising from their use of the Platform, including income tax on Rewards received, HST/GST obligations, and any other applicable taxes. Property Bounty does not provide tax advice. Bounty Hunters are responsible for reporting Reward income to the Canada Revenue Agency (CRA) or applicable tax authority.
  7. No hidden fees. Property Bounty does not charge any fees beyond the Platform Fee described above. Stripe may charge its own processing fees, which are separate from and in addition to the Platform Fee.
  8. Fee changes. Property Bounty reserves the right to change the Platform Fee rate at any time. Changes will apply only to Bounties created after the effective date of the change. Existing funded Bounties retain the fee rate in effect at the time of checkout.

9. Bounty Hunter Obligations & Representations

By activating Bounty Hunter mode and submitting properties, you represent, warrant, and agree that:

  1. Accuracy. All information in your Submissions — including property addresses, asking prices, square footage, seller contact details, and any other details — is accurate, truthful, and not misleading to the best of your knowledge.
  2. Genuine matches. You will only submit properties that genuinely match the Bounty criteria. Submitting irrelevant, fabricated, or low-effort properties to “farm” Bounties is Prohibited Conduct.
  3. Seller consent. You have a reasonable basis for providing seller contact details and are not violating any confidentiality agreement, listing agreement, or privacy obligation by doing so.
  4. Regulatory compliance. You are solely responsible for ensuring your activities comply with all applicable laws and regulations, including but not limited to provincial real estate licensing requirements (such as Ontario’s Trust in Real Estate Services Act, BC’s Real Estate Services Act, and equivalent legislation in other provinces), anti-spam legislation (CASL), and privacy legislation (PIPEDA, provincial equivalents).
  5. No guarantees. You do not guarantee the outcome of any transaction and you acknowledge that the Buyer is under no obligation to purchase any property you submit.
  6. Independent contractor. You are an independent contractor, not an employee, agent, or representative of Property Bounty. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Property Bounty.
  7. Payout prerequisites. You must complete Stripe Connect identity verification and provide valid banking details before any Reward can be released to you. Failure to complete onboarding within thirty (30) days of a confirmed Closing may result in the payout being marked as failed, at which point you must contact support to reattempt.
  8. Reputation. Your reputation score on the Platform is based on your submission acceptance rate and closed deal count. Attempting to manipulate your reputation through fake accounts, colluding with Buyers, or any other means is Prohibited Conduct.

10. Dispute Resolution

10.1 Platform Dispute Process

  1. If a Bounty Hunter believes a Closing attestation is false or premature, the Bounty Hunter may file a Dispute during the Counter-Sign Window by providing a written explanation of the issue.
  2. Upon receipt of a Dispute, the Closing is suspended and the Reward Charge remains pending review. Property Bounty will review the Dispute and may request additional information or documentation from either party.
  3. Property Bounty will make a determination within thirty (30) calendar days of receiving all requested information. The determination may result in:
    • Release of the Reward to the Bounty Hunter (if the Closing is confirmed legitimate);
    • Cancellation of the Bounty and refund to the Buyer (if the Closing is found to be false or premature); or
    • Such other resolution as Property Bounty deems fair and appropriate under the circumstances.
  4. Property Bounty’s determination is final and binding on both parties. By using the Platform, you waive any right to challenge the determination except through the legal process described in Section 10.2.
  5. Property Bounty may document the dispute resolution, including the reasoning and outcome, and retain this record indefinitely for compliance and fraud prevention purposes.

10.2 Formal Dispute Resolution

  1. Negotiation. Before initiating any formal proceedings, the parties agree to attempt to resolve any dispute arising out of or relating to these Terms through good-faith negotiation for a period of not less than thirty (30) days.
  2. Mediation. If negotiation fails, the parties agree to submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator in Toronto, Ontario. Each party shall bear its own costs of mediation plus an equal share of the mediator’s fees.
  3. Litigation. If mediation fails, either party may commence legal proceedings in the courts of the Province of Ontario, and the parties irrevocably submit to the exclusive jurisdiction of those courts. The prevailing party in any litigation shall be entitled to recover its reasonable legal costs and disbursements from the non-prevailing party.
  4. Class action waiver. To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Property Bounty.
  5. Injunctive relief. Notwithstanding the foregoing, Property Bounty reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened violation of these Terms, including but not limited to circumvention, fraud, or misappropriation of intellectual property.

11. Buyer Obligations & Representations

By creating and funding a Bounty, you represent, warrant, and agree that:

  1. Genuine intent. You have a genuine intent to acquire a property matching your Bounty criteria. Creating Bounties for the purpose of harvesting seller contact information, conducting market research, or any purpose other than acquiring property is Prohibited Conduct.
  2. Sufficient funds. The payment method used at checkout is yours (or you are authorized to use it), and you have sufficient funds or credit to cover the Held Amount. Chargebacks initiated in bad faith are Prohibited Conduct and may result in account termination, forfeiture of pending refunds, and legal action.
  3. Accurate criteria. The property criteria specified in your Bounty are accurate and reflect your genuine requirements. Posting misleading criteria to attract Submissions you have no intention of acting on is Prohibited Conduct.
  4. Timely review. You will review Submissions in a timely manner. While the Platform does not impose a mandatory review timeline, persistent failure to review Submissions may result in the Bounty being flagged or cancelled.
  5. Honest closing attestation. You will only mark a deal as closed when a binding real-world transaction has actually occurred. Falsely attesting a Closing — whether to trigger a premature payout, to lock out other Bounty Hunters, or for any other reason — is fraud and will be treated as such.
  6. No-circumvention. You will comply with all provisions of Section 6 (No-Circumvention Obligation). This obligation is absolute and survives termination of your account and these Terms.

12. Prohibited Conduct

The following activities are strictly prohibited. Engaging in any of the following constitutes a material breach of these Terms and may result in immediate account suspension, forfeiture of funds, and legal action:

12.1 Fraud & Manipulation

  • Creating fake, duplicate, or misleading accounts.
  • Submitting fabricated, plagiarized, or materially false property information.
  • Filing false Closing attestations or false Disputes.
  • Manipulating reputation scores, submission counts, or other Platform metrics through fake transactions, sock puppet accounts, or collusion with other Users.
  • Impersonating another person, entity, or Property Bounty employee.
  • Using automated scripts, bots, crawlers, or scrapers to interact with the Platform without explicit written permission from Property Bounty.

12.2 Circumvention & Financial Misconduct

  • Circumventing the Bounty payment system as described in Section 6.
  • Initiating bad-faith chargebacks, payment reversals, or disputes with your bank to avoid paying for a Bounty.
  • Using stolen payment methods, engaging in money laundering, or facilitating any financial crime through the Platform.
  • Colluding with other Users to split Rewards off-platform, deflate Reward amounts, or otherwise undermine the marketplace.
  • Creating Bounties with no genuine intent to purchase, for the purpose of harvesting leads, gathering market intelligence, or wasting Bounty Hunters’ time.

12.3 Abuse & Harassment

  • Harassing, threatening, intimidating, or stalking any User, seller, or Property Bounty employee.
  • Sending unsolicited communications, spam, or promotional material through or in connection with the Platform.
  • Discriminating against Users on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected ground under Canadian or provincial human rights legislation.
  • Posting or transmitting content that is defamatory, obscene, hateful, or otherwise objectionable.

12.4 Platform Integrity

  • Attempting to access, probe, or test the vulnerability of the Platform or any related system without authorization.
  • Interfering with or disrupting the Service, servers, or networks connected to the Service.
  • Reverse engineering, decompiling, or disassembling any part of the Platform.
  • Circumventing any rate limits, access controls, or other technical measures implemented by the Platform.
  • Extracting, scraping, or bulk-downloading data from the Platform for any purpose.

12.5 Legal Violations

  • Violating any applicable federal, provincial, municipal, or international law or regulation.
  • Engaging in unlicensed real estate activity where such activity requires a license.
  • Violating privacy laws by mishandling personal information obtained through the Platform.
  • Facilitating or participating in any illegal transaction, including but not limited to transactions involving proceeds of crime.

13. Enforcement & Consequences

Property Bounty takes platform integrity seriously. Enforcement actions are proportional to the severity and intent of the violation:

  1. Warning. For minor or first-time infractions, Property Bounty may issue a written warning specifying the violation and required corrective action.
  2. Temporary suspension. For moderate or repeated infractions, accounts may be temporarily suspended for a period determined at Property Bounty’s sole discretion. During suspension, the User cannot log in, create Bounties, submit properties, or access pending refunds.
  3. Permanent termination. For severe violations, including any form of fraud, circumvention, or repeated Prohibited Conduct, accounts may be permanently terminated. Termination is immediate and without notice. Terminated Users may not create new accounts.
  4. Fund forfeiture. In cases of fraud, circumvention, or material breach, Property Bounty may suspend pending payouts, reverse Reward Charges, or retain Platform Fees. Forfeited amounts may be used to compensate the injured party or retained by the Platform.
  5. Legal action. Property Bounty reserves the right to pursue civil litigation, seek injunctive relief, and/or report criminal conduct to law enforcement authorities, including the RCMP, provincial police, FINTRAC, and applicable real estate regulatory bodies.
  6. Data retention. Information about violations, enforcement actions, and terminated accounts is retained indefinitely for fraud prevention and may be shared with law enforcement and regulatory authorities as required by law.
  7. No appeal for fraud. Users terminated for fraud or circumvention have no right of appeal. For all other terminations, Users may submit a written appeal to [email protected] within fourteen (14) calendar days of termination. Property Bounty will review the appeal and respond within thirty (30) days. The appeal decision is final.

14. Intellectual Property

  1. Platform IP. All Intellectual Property in the Service — including the Property Bounty name, logo, design, software, algorithms, and documentation — is owned by or licensed to Property Bounty. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.
  2. User content. By posting Bounties, Submissions, or other content on the Platform, you grant Property Bounty a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to use, reproduce, modify, and display that content for the purposes of operating, improving, and promoting the Service. You represent that you have all necessary rights to grant this license.
  3. Feedback. Any feedback, suggestions, or ideas you provide about the Platform become the property of Property Bounty without any obligation to you. We may use such feedback for any purpose without compensation or attribution.

15. Disclaimers

  1. Marketplace only. Property Bounty is a marketplace that connects Buyers and Bounty Hunters. The Platform does not itself buy, sell, lease, or broker real estate. The Platform is not a real estate brokerage, a real estate agent, a mortgage broker, or a financial advisor.
  2. No guarantee of results. Property Bounty does not guarantee that any Bounty will receive Submissions, that any Submission will lead to a closed deal, or that any property submitted by a Bounty Hunter is suitable, available, or accurately described.
  3. No due diligence. Property Bounty does not perform due diligence on properties submitted by Bounty Hunters. Buyers are solely responsible for conducting their own inspections, appraisals, title searches, environmental assessments, and other due diligence before purchasing any property.
  4. No legal or tax advice. Nothing on the Platform constitutes legal, tax, financial, or real estate advice. Users should consult qualified professionals for all such matters.
  5. “As is” service. The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. Property Bounty does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
  6. Third-party services. The Platform integrates with third-party services (including Stripe) over which Property Bounty has no control. We are not responsible for the availability, accuracy, or conduct of any third-party service.

16. Limitation of Liability

  1. Cap on liability. To the maximum extent permitted by applicable law, the total aggregate liability of Property Bounty and its officers, directors, employees, and agents for all claims arising out of or relating to these Terms or the Service shall not exceed the lesser of: (a) the total amount of Platform Fees actually paid by you in the twelve (12) months preceding the event giving rise to the claim; or (b) five hundred Canadian Dollars (CAD $500).
  2. Exclusion of damages. In no event shall Property Bounty be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to: lost profits, lost revenue, lost data, loss of goodwill, cost of procurement of substitute services, or damages for business interruption, however caused and regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Property Bounty has been advised of the possibility of such damages.
  3. Specific exclusions. Without limiting the generality of the foregoing, Property Bounty shall not be liable for:
    • The quality, legality, safety, or suitability of any property submitted by a Bounty Hunter;
    • The accuracy of any information provided by any User;
    • The outcome of any real estate transaction facilitated through the Service;
    • Losses arising from unauthorized access to your account due to your failure to secure your credentials;
    • Losses caused by Stripe, banks, or other third-party payment processors;
    • Service interruptions, data loss, or technical failures beyond our reasonable control;
    • Any action or inaction by any other User of the Platform.
  4. Essential purpose. The limitations in this section shall apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.
  5. Jurisdictional limits. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Property Bounty’s liability is limited to the maximum extent permitted by applicable law.

17. Indemnification

You agree to indemnify, defend, and hold harmless Property Bounty, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys’ fees and legal costs) arising from or related to:

  • Your use of the Service or any activity under your account;
  • Your violation of these Terms or any applicable law;
  • Your violation of any third party’s rights, including intellectual property, privacy, or contractual rights;
  • Any content you post, submit, or transmit through the Service;
  • Any real estate transaction in which you participate that was facilitated through the Platform;
  • Any claim by a seller, buyer, real estate agent, or other third party arising from your use of the Platform;
  • Any regulatory action, fine, or penalty arising from your unlicensed or non-compliant real estate activities.

This indemnification obligation survives the termination of your account and these Terms. Property Bounty reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, without limiting your indemnification obligations.

18. Privacy & Data

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

You acknowledge that seller contact details shared through Submissions are encrypted at rest and are only disclosed to the Buyer upon acceptance of the Submission. You agree not to use seller contact details for any purpose other than pursuing the specific property transaction contemplated by the Bounty.

19. Force Majeure

Property Bounty shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government actions or orders, labor disputes, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including Stripe).

20. Modifications to These Terms

  1. Property Bounty reserves the right to modify these Terms at any time. Changes are effective upon posting to the Platform, unless a later effective date is specified.
  2. For material changes (including changes to fees, dispute procedures, or liability provisions), we will provide at least thirty (30) days’ notice via email or a prominent notice on the Platform.
  3. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and close your account.
  4. Active Bounties created before a Terms modification remain subject to the Terms in effect at the time those Bounties were funded, except where the modification is required by law.

21. Governing Law & Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, for any legal proceeding arising out of or relating to these Terms.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect. The invalidity of any provision in a particular jurisdiction does not affect the validity of that provision in any other jurisdiction.

23. Entire Agreement

These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Property Bounty regarding the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term, and Property Bounty’s failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
